因為新冠肺炎疫情衝擊,政府推出的紓困專案也吸引不少申請量,結果卻衍生銀行行員超時工作、少領加班費等問題。而台北市勞動局公布了突襲式夜間勞檢結果,包含台灣銀行在內的6家金融機構,全數違規。

The government relief package aimed at helping troubled companies has been rather popular due to the COVID-19. But for the bank workers, who deal with the applications on the front line, overloading becomes an issue. The Department of Labor Agency of the Taipei City Government (DOLA) has inspected 6 financial instituions without former notification recently; all six were found illegal, including the Bank of Taiwan.

民眾站在櫃檯前申請紓困貸款,行員忙進忙出、來來回回不停處理文件,北市勞動局日前就接獲陳情,指出行員趕辦紓困貸款業務,超時工作少領加班費,還有人一個月加班超過60小時,而勞動局長率隊在7月底到8月中夜間突襲勞檢,包括台灣銀行在內的6家金融機構,檢查結果通通違規。

That shows the reason why the DOLA carried out the surprise inspection on 6 financial institutions after the government received the information that many bank workers were forced to work overtime--some of them worked more than 60 hours of overtime a month--and didn't get the right amount of their overtime pay. All six institutions, including the Bank of Taiwan, were found illegal.

北市勞動局長陳信瑜呼籲:「資方不要拿著『事變』當擋箭牌,甚至是開了這個所謂的過勞的大門,如果造成勞工的職業病或者是過勞致死的時候,我相信這都是事情嚴重了。」

"Companies should not take the 'unexpected event' as their excuse for opening the door to overwork. Once the labors get sick or even death due to occupational accidents, that's nothing easy to overcome." Chen, shin-yu(陳信瑜), the head of the DOLA, said.

勞動局更發現不少資方鑽漏洞,像是台灣銀行修改員工加班的上限時數、以值班費取代加班費,加班4小時只能領600元,還暗示員工將加班費換成補休;渣打銀行則沒有核實記載員工的出勤時間,而富邦、凱基、元大三家銀行,延長員工工時、週末加班,卻少給或未給出勤工資;富邦和元大還沒有在限期內通報工會或勞動局備查,至於信保基金,在沒有工會的同意下就擅自讓勞工加班。更透露突襲受檢當下,不少業者趕緊讓同仁下班,避免違規。

Scams were also found in the inspection. The Bank of Taiwan made up the maximun of overtime limits, altered the amount of overtime pay and asked their employees to chose compensatory leave instead of money, which was only about 600 NTD for 4 hours of overtime work. Standard Chartered hasn't  kept their attendance records accurately, while Fubon, KGI and Yuanta Bank illegaly cut their payments for overtime workers. Fubon and Yuanta also hasn't notified the labor union and the DOLA of the employees' exceeded hours in time, with the Credit Guarantee Fund didn't get the consent of the labor union at all. At the time of the inspection, some banks urged their emploees to get off work to observe the law in order not to violate the law.

陳信瑜說:「主管還當著我的面說,現在通通下班了,現在都去下班了,記得要報加班,記得報加班。」

"Just in front me, one supervisor said: get off work now, and remember to send the overtime application."
